Who appoints the port agent - the owner or the charterer?

Appointment depends on the charter party. Either the owner/operator or the charterer can nominate the agent. Often in a time-charter the charterer has the right to nominate. However, even when a charterer nominates the agent, legally the owner remains the principal paying the fees. In practice, if only one agent is appointed, the other party may still have the right to appoint a protective agent to safeguard their interests.

What is the difference between a full agent and a protective agent?

A full agency appointment means the agent handles the entire port call on behalf of one party (owner or charterer) - from berthing to final accounts. A protective agent is appointed by the other party when they did not name the principal agent. The protective agent’s role is limited: they monitor documentation, inspect cargo or vessels if needed, and ensure the main agent isn’t overlooking anything. A protective agent is there to protect the appointing party’s interests, particularly in cargo, documentation, and claims-related matters.
